By using our real estate photography services, you agree to the following terms and conditions. Please read them carefully before booking services, accessing or downloading any photography files. If you do not agree to these terms, you may not access or use our services.

1. Scope of Services

We provide professional photography services for real estate purposes. The final images are intended solely for marketing and promotional purposes related to the property being photographed.

2. Usage Rights

The client is granted a non-exclusive, non-transferable license to use the images solely for the marketing and sale of the property listed in the agreement.

Images may not be sold, leased, or transferred to third parties without prior written consent of Nest Vision Media.

Any unauthorized use, duplication, or modification of the images is prohibited.

3. Copyright Ownership

All images remain the intellectual property of Nest Vision Media. The client’s license to use the images is limited to the scope outlined above.

4. File Access and Download

Files will be delivered via an online platform, email, or Google Drive link. Accessing the files constitutes acceptance of these terms.

Clients are responsible for downloading and backing up their files within 14 days of delivery. After this period, access may be restricted, and media may no longer be available. Nest Vision Media will not be responsible for retaining or hosting files beyond this period.

By downloading media, you acknowledge and agree to these terms and conditions.

5. Payment Terms

Real Estate Agents:
Payment is due in full upon delivery of media and invoice, unless prior arrangements have been made in writing.

Failure to submit payment will result in denial of future appointments.

Homeowners:
Full payment is required upfront at the time of booking. Services will not be completed until payment is received.

Payments are non-refundable unless one of the following conditions is met:

1. The service is canceled a minimum of 3 hours in advance.

2. Nest Vision Media is unable to deliver the agreed-upon services. A refund will only be issued for services that were not rendered.

3. There is a verifiable issue with the quality of the deliverables that cannot be resolved.

6. Cancellation and Rescheduling

Cancellation or rescheduling requests must be made at least 3 hours before the scheduled shoot.

A $50 cancellation fee will be charged for cancelations made with less than 3 hours’ notice.

A $25 rescheduling fee will be charged for changes made with less than 3 hours’ notice.

A $100 service fee will apply if the property is inaccessible upon the photographer's arrival and the client cannot be reached.

Rescheduling is subject to photographer availability.

7. Liability

We are not liable for delays or failures due to circumstances beyond our control, including but not limited to weather conditions, equipment malfunctions, or access restrictions.

Our liability is limited to the total amount paid for the services.

8. Property Preparation

The client is responsible for ensuring the property is fully prepared and accessible at the scheduled shoot time. The photographer will capture the property in its current condition and is not responsible for staging, cleaning, or making preparations. While minor adjustments may be made, such as adjusting blinds, closing toilet lids, or repositioning small items, this is at the photographer’s discretion and not guaranteed. It is the client’s responsibility to have the property ready or be present to make any necessary changes.

9. Dispute Resolution

Any disputes will be resolved amicably or through arbitration under Indiana Laws.

10. Acceptance of Terms

By booking services, or by accessing or downloading the files provided, you confirm your acceptance of these terms and conditions.

11. Service Areas

The photographer may require the listing agent to be present for certain service areas. If requested, the listing agent must attend the full photo shoot.
